K.S.GAREWAL

body2004
JUDGMENT K.S. Garewal, J. - Moti Sagar got married to Gunjan on June 18, 2003. Dispute arose giving rise to FIR 118 dated March 5, 2004 under Sections 406/498-A/506 Indian Penal Code registered at P.S. City Yamuna Nagar against Moti Sagar and seven others, who are petitioners before this Court. 2. Annexure P-2 is written compromise executed between Gunjan and Moti Sagar and seven others through which the parties have decided that their marriage was illegal, null and void and there was no need to get the said marriage declared null and void (??). Be that as it may, the wife has received Rs. 2.00 lacs from the husband and the presents have also been returned to her. 3. Since the complainant is no longer interested in pursuing the complaint and prosecuting the petitioners, it is very unlikely that the prosecution will succeed. Therefore, in order to give the parties a chance to find conjugal happiness elsewhere while they are still young, F.I.R. 118 dated 5.3.2004 registered at P.S. City Yamuna Nagar under Sections 406/498-A/506 Indian Penal Code is hereby quashed. Petition allowed.
