ORDER Heard counsel for the parties. 2. The petitioner prays for issuance of a direction upon the respondents to appoint him on the post of police constable in Saran Range, Chapra pursuant to advertisement no. 1/98. 3. Precisely, it is stated by learned counsel for the petitioner that the petitioner was found as a successful candidate in the physic cal test and thereafter vide communication as contained in Annexure-3 he was asked to appear before the Board again along with requisite documents including certificate of experience as Homeguard Jawan. The petitioner, accordingly, appeared before the Board but till date no decision has been taken and posts are still lying vacant. 4. When I asked learned counsel for the petitioner as to whether the petitioner had appeared before the Board and produced experience certificate and as to whether he had worked as Homeguard Jawan, learned counsel submitted that since he was not a Homeguard Jawan this certificate was not produced. 5. At this stage, it would be very difficult for this Court to examine as to whether in this regard pursuant to the advertisement, petitioner produced certificate of experience as Homeguard Jawan. Prima facie, it appears from Annexure-7 that the petitioner was asked to produce experience certificate of Homeguard Jawan. The requirement, however, has not been fulfilled by the petitioner by not producing requisite certificate. 6. Whatsoever learned counsel for the petitioner submits that this representation is pending consideration before the authorities as contained in Annexure 5. In the given facts and circumstances of this case, in my opinion, no useful purpose will be served by directing the authorities to go on examining the claim of the individual like this. In that view of the mater, I am not inclined to issue any direction to the authorities to even consider his representation. 7. However, the authorities will at liberty to proceed in the mater afresh, if so advised, in accordance with law.
