JUDGMENT By this petition, the petitioner has prayed for grant of pension, gratuity, leave encashment and other retiral benefits. Submission of learned counsel for the petitioner is that the period in which the petitioner worked as Gram Sahayak in Gram Panchayat in the district of Durg should be included for the purpose of computation of pension and the period should be confined to the date of absorption, i.e., 6.7.1989. It is also contended that if the said period is computed, all other benefits would accrue in favour of the petitioner. Though a return has been filed resisting the claim, Mr. Rahul Jain, learned counsel for the respondent, says that in a number of cases it has been held that the services rendered in this kind of organization are to be computed for the purpose of retiral benefit. In view of the aforesaid, I am inclined to direct that the period of service rendered as Gram Sahayak shall be computed for the purpose of retiral dues and the same shall be paid to the petitioner within a period of three months from the date of receipt of the order passed today. As the matter was in efflux for some time, I am not inclined to grant interest to the petitioner at the rate of 18% p.a. as claimed but confine it to 6% p.a. The writ petition is accordingly disposed of. There shall be no order as to costs.
