ORDER : SL.P(CRL. NO.472/2004 1. Heard the learned counsel for the parties. 2. We direct the Director General of Police of the State of Gujarat to cause further investigate in GR No.I-134 of 2003 of Kodinar Police Station and submit a report before the next date of hearing. Report shall indicate specifically as to the propriety of the action taken by the Inspector to delete some of the offences as were originally indicated. He shall also indicate as to whether any further investigation is desirable. The Director General shall be free to take assistance of such officials as he may feel necessary for the purpose of investigation. We make it clear that we have not expressed any opinion at this juncture about the propriety of the changes done by the Investigating Officer and/or the need for further investigation. Learned counsel for the State of Gujarat is also directed to place the case diary on the next date of hearing. List this matter on 2.4.2004. 3. Leave is granted in SLP(Crl) No.358/2004. 4. The appeal is allowed and the bail granted to the accused Res.No.2, namely, Pratap Mansingh Solanki, is cancelled in terms of the signed order.
