JUDGMENT : A.K. Parichha, J. - Heard the Learned Counsel for the Petitioner and learned Addl. Govt. Advocate. Petitioner is facing trial u/s 307/34 of the I.P.C. in the Court of the learned Asst. Sessions Judge, Kendrapara. The prayer for bail was rejected by that Court. Thereafter the Petitioner has filed this bail application on the ground that he is innocent that even though most of the witnesses have been examined, none has implicated him in the alleged offence. 2. Learned Addl. Govt. Advocate submits that the allegations against the Petitioner is serious in nature and so he should not be let out on bail. 3. The Petitioner has remained in custody for more than a year. There was an order by this Court in BLAPL No. 9356 of 2003 dated 23.2.2004 that the Petitioner will be released on bail, if trial is not concluded by end of July, 2004. Considering the fact that the trial has not been completed and that the Petitioner has remained in custody for a considerable time, bail can be granted. 4. Accordingly, let the Petitioner be released on bail of Rs. 10,000/- (Rupees ten thousand) with two local solvent sureties each for the like amount to the satisfaction of the learned C.J.M., Kendrapara in S.T. No. 42/247 of 2004. BLAPL is disposed of. Urgent C Copy of the order be granted as per rule.
