M. P. SINGH, J. Heard the learned Counsel for the parties and perused the materials on record. 2. The learned Magistrate dismissed the application under Section 156 (3) Cr. P. C. of the revisionist to lodge a F. I. R. against the accused persons. The learned Magistrate dismissed the application of the revisionist on 5-2-04. The police without obtaining the order of the Magistrate conducted the investigation. 3. It was contended by the revisionist counsel that the learned Magistrate without applying his mind to the facts of the case has rejected the application of the revisionist. 4. The order of the Magistrate dated 5-2-04 is recalled. The Magistrate is directed to dispose of the application under Section 156 (3 ). 5. This revision stands thus allowed with the aforesaid observation. Revision allowed. .
