Judgment 1. Heard counsel for the parties. 2. Despite order dated 15.12.2000 no counter affidavit has been filed on behalf of the State. 3. This pertains to grant of time bound promotion to the petitioner with due date, as the same has been given to similarly situated persons and also for payment of monetary benefits on account of promotion. 4. JC to SC 3 on instruction submits that the petitioner has already been promoted and selection grade scale has been given to him with due date and thus, the grievances of the petitioner have been redressed. 5. From the pleadings of the parties, it appears that the petitioner by now has superannuated and the main thrust of argument of learned counsel for the petitioner is for grant of consequential monetary benefit on account of promotion given to him. Merely because the selection grade scale has been given to the petitioner, the grievances will not be redressed unless the monetary benefit is given to him. 6. Under the circumstances, the respondent authorities are directed to give monetary benefit to the petitioner with effect from the date of his promotion within a period of three months from the date of receipt/production of a copy of this order. 7. With the direction/observation aforesaid, this application is disposed of.
