Judgment 1. This application under Section 482, Cr PC is filed by the petitioner for quashing the order dated 2.12.2002, passed by Judicial Magistrate, Patna in Complaint Case No. 1337 (C) of 2002 by which cognizance has been taken against the three accused persons including the petitioner for the offence under Sections 420, 406 and 120-B of the Indian Penal Code. 2. On the last occasion time was taken by the counsel appearing for opposite party No. 2. Counsel appearing for opposite party No. 2 the complainant submitted that there is likelihood of compromise by the parties and the petitioner will pay Rupees five lacs to complainant and the complainant thereafter will not pursue this proceeding. 3. Today a draft of rupees five lacs has been presented by the petitioner payable to complainant. The parties have compromised and they do not intend to further proceed in the matter. 4. Under the circumstances the order dated 1.12.2002, passed by the Judicial Magistrate, Patna in Complaint Case No. 1387 (C) of 2002 is hereby quashed and the application is allowed. 5. However, it is made clear that this order will be applicable in the case of petitioner B.C. Jawali, who is President of Hyderabad Karnataka Education Society, Gulbarga and also against another accused who is the President of Hyderabad Karnataka Education Society Gulbarga, Karnataka. So far the proceeding in respect of accused Mr. Sudhir Patil is concerned, the same will continue. 6. The complainant has received a draft of rupees five lacks and he has given and undertaking that he will not proceed further in the matter in respect of petitioner in this application as well as accused No. 1 in the complaint petition.
