JUDGMENT Rajesh Tandon, J. : Heard Sri A.D. Massey, learned counsel for the ,evisionist and learned A.G.A. 2. Admit. Issue notice. 3. Learned counsel for the revisionist has argued that Bhanu Pratap Singh-revisionist is a person of unsound mind and the revisionist is lying in the mental hospital but this fact has not been taken into account by the preceding officer, While granting the maintenance allowance, the preceding officer has not taken into account regarding monthly income of the• revisionist. No finding has been recorded that the revisionist is earning from the agricultural land Whether the agricultural land is yielding any income or not no finding has been made in this regard. 4. The respondent may file counter affidavit. Put the thereafter, In the meantime, if the revisionist pays a sum of Rs. 250 (Rupees two hundred fifty only) to the respondent No.1 from the date of the application filed, the operation of the order shall remain stayed. As the amount dues during the pendency of the case are concerned, the 'revisionist shall furnish a sum of Rs. 3,000 (Rupees three thousand only). Operation of order Stayed.
