Judgment 1. In re. the incident at the Civil Court, Bagha on 11.5.2004 a committee has been constituted to report the details on what exactly had happened on that day. The committee has submitted its report. The District Judge, West Champaran, Bettiah, has also submitted his report. 2. Mr. Rajendra Prasad Singh, Sr. Advocate, a member of the committee, points out the court that certain names as are mentioned in the report of the District Judge dated 19.5.2004 are not in the report of the committee. He explains the situation to the effect that on the day when the committee was carrying out its commission some persons were not present. Perhaps, these escaped the notice of the committee. A request is made that the names indicated by the committee as having conducted violence and the names indicated by the district judge in his report be combined. These are; Shyam Bihary Ram, Dy. S.P. Bagha, Gajendra Prasad Singh, Secretary Police Association, Bagha, Srikant Mishra, Constable, Nand Kumar Pathak, Sergeant, Rajendra Paswan, Constable, Harendra Paswan, Constable, Gajendra Paswan, Constable, Sergeant Major, Police Line Bagha, Purushottam Singh, Constable, Ram Janam Singh, Hawaldar/Constable, Shankar Mishra, Line Babu, Sriram Pandey, Constable, Ram Chandra Paswan, Constable, Surendra Yadav, Constable, Officer-in-Charge, Path Kholi and Ram Bilash Jha, Constable. 3. This matter is about violence within the premises of the Civil Court, Bagha. Persons who conducted it have been prima facie inquired upon by the committee. Violence within the court premises will tantamount to obstructing the public justice. 4. A copy of this order which contains the names of persons between the reports of the District Judge and the four member committee which executed a commission on 21.5.2004, be sent by Fax Facsimile and E mail to the District Judge, West Champaran, Bettiah. When the District Judge receives the order, he will ask the Superintendent of Police, Bagha to serve a copy of this order on each of the persons named in the reports by noon tomorrow. They shall be present before the court day after tomorrow. 5. As these proceedings partake the nature of a criminal contempt, issue notice to the Advocate General, Bihar. 6. Put up day after tomorrow under the same heading.
