VIJAY KUMAR P. MEHRA v. PREMLATA MEHRA

2004-01-15

body2004
( 1 ) HEARD learned counsel for the appellant. In substance the appellant seeks to fix liability on the plaintiff-respondents and make them liable for the loss occasioned to the appellant on account of a bona fide mistake committed by the receiver who is an officer of the Court. Though loss may have been caused to the appellant, the plaintiff-respondents cannot be burdened with the liability. We do not find any cause to interfere with the view taken by the High Court. The appeal is dismissed.
