Judgment 1. Heard counsel for the parties. 2. It pertains to correction of date of birth of the petitioner in the matriculation certificate. 3. According to the case of the petitioner, the petitioner passed the matriculation examination in the year 1990. However, the matriculation certificate was issued in the year 1999, where the petitioner found certain discrepancies in his date of birth, which was mentioned as 1.4.1974 instead of 1.4.1976. The petitioner thereafter saw a communique issued by the respondent Board in a newspaper in the year 1999 itself, which was issued inviting applications from desirous persons for correction of the names and date of birth in the matriculation certificate. The petitioner also applied in prescribed proforma before the respondent Board for necessary correction of date of birth in the matriculation certificate, which ultimately was rejected vide order, as contained in annexure 9 saying that after several years of the examination, it would not be possible to correct the date of birth. 4. Mr. J.P. Shukla, learned senior counsel for the respondent Board, submitted that the matter requires reconsideration from the end of the respondent Board, as they have not considered the prayer of the petitioner in the light of the communique issued by the respondent Board. 5. Considering the facts and circumstances of the case, this application is allowed, order impugned, as contained in annexure 9, is set aside and respondent no. 2, Secretary, Bihar School Examination Board, is directed to consider the application of the petitioner and pass necessary orders pertaining to his date of birth on the basis of the documents available in the office. This exercise, however, must be completed within six weeks from the date of receipt/production of a copy of this order.
