ORDER : R.C. Lahoti, J. Mr Manoj Goel, the learned counsel appearing for the writ petitioners in WPs (C) Nos. 604, 616 of 2002, 25, 27 and 33 of 2003 commenced his arguments and addressed the Court from 10.50 a.m. to 11.40 a.m. Thereafter Mr P.P. Rao, the learned Senior Counsel for the Medical Council of India addressed the Court till 12.30 p.m. Then Mr. Manoj Goel appearing for the writ petitioners continued with his submissions and was on his legs when the Court rose for the day leaving the matters part-heard. 2. We have heard the learned counsel for the parties for full two days. We were almost nearing the conclusion of hearing. During the course of hearing, we have put it across to the learned counsel for the petitioners and the learned counsel for the Union of India as also for the Medical Council of India that in the event of the Court forming an opinion that the students who have graduated from foreign universities and especially from the universities of the erstwhile USSR should undergo a screening test and practical training before being held entitled to permanent registration for medical practice in India then what should be the nature, content and methodology of test and who should conduct it? The learned counsel for the respondents assure that they would hold high-level consultation and come back to the Court with their suggestions. The learned counsel for the petitioners state that they have also suggestions which they would be handing over to the learned counsel for the respondent Union of India and the Medical Council of India within a week. The Union of India and the Medical Council of India must respond on or before 5-7-2004. While doing so, the respondents are at liberty to consult the National Board of Examinations and such other expert bodies as they deem fit. The petitioners herein may sit together and nominate any two representatives of theirs and inform their names and addresses to the Union of India and the Medical Council of India through their counsel. These representatives shall be allowed hearing in the process of finalising the nature, screening and methodology of the test proposed. 3. List for directions on 12-7-2004.
