JUDGMENT 1. - By the instant writ petition the petitioner has prayed to direct 1 respondents to treat the petitioner eligible and qualified for appointment on the post of Teacher Grill and to give him appointment according to his merit with ail consequential benefits. 2. The petitioner after qualifying B.Sc. examination in the year 1994, obtained B.Ed. degree in the year 1996-97 from University of Kashmir with 57.77% marks. Thereafter pursuant to the advertisement dated June 13, 1998 issued by Ziia Parishad Alwar, the petitioner submitted application for the post of Teacher Grade-111. The petitioner stood at Sr. No. 181 in genera; category in the interview held on June 29, 1998. Zila Parishad Aiwar 10 issued final list of selected candidates and the candidates who were in waiting list in June, 1999, wherein the name of petitioner has shown at Sr.No. 32, the word 'P.C.' was mentioned against the name of petitioner as he was treated as provisional for enquiry regarding his B.Ed. degree. The petitioner was declined appointment on the ground that he obtained B.Ed. degree from University of Kashmir which was not recognised by National Council for Teacher Education (for short 'NCTE'). It is averred by the petitioner that University of Kashmir was recognised by University Grants Commission in its list dated September 1, 1996. it is further pleaded by the petitioner that candidates namely Brij Govind and Koshal Kishore, who respectively stood at Sr. No. 190 and 191, got appointment on the post of Teacher Grade Ill, whereas the petitioner who stood at Sr.No. 181 was discriminated. One Sanjeev Kumar, who obtained B.Ed. degree from University of Kashmir also got appointment but the petitioner could not get justice. 3. In the reply to the writ petition the respondents pleaded that the B.Ed. degree of University of Kashmir is not in the list of NCTE therefore the s petitioner is not entitled for appointment. The decree is to be recognised by NOTE and not by University Grants Commission. 4. Having analysed the submissions and material on record, I find that case of the petitioner is not distinguishable with that of the case of Surendra Kumar Gupta v. State of Rajasthan and others (SBCWP No. 326/2000 to decided on November 22, 2002) who obtained B.Ed. degree from University of Kashmir and was directed to be appointed on the post of Teacher Grade III.

On the case on hand an interim order was passed on January 18, 2000 whereby the respondents were directed to keep one post of Teacher Grade III vacant. The respondents are therefore directed to appoint the petitioner on the post of Teacher Grade III according to his merit position. Length of service of the petitioner shall be counted from the date the candidates lower In merit to the petitioner got appointment but the petitioner shall be entitled to monetary benefits from the date he joins the service. The necessary exercise shall be made within one month from the date of receipt of certified copy of this order. There shall be no order as to costs. 5. The writ petition stands allowed as indicated above.Writ Petition Allowed. *******
