(5 of 1908), O.9, R. 13, Ex-planation - Ex parte decree/award - Setting aside of - Procedure - Dismissal of appeal filed against ex parte decree/award on ground of limitation - It would bar subsequent application under O.9, R. 13 for setting aside ex parte decree/award. ``Explanation was added to Order IX, Rule 13 with effect from February 1, 1997 by the Code of Civil Procedure (Amendment Act, 1976) Prior to its enactment a defendant burdened by an ex parte decree could apply under Order IX, Rule 13 for setting aside the ex parte decree. He could also file an appeal under Section 96 against the ex parte decree. The mere fact of filing the appeal did not take awa the jurisdiction to entertain and dispose of an application for setting aside an ex parte decree. Only in the cases in which the Trial Court decree merged with the order of the appellate Court by reversal confirmation or varying it, the Trial Court was precluded from setting aside the ex parte decree. Where the Trial Court decree did not merge with the appellate Court order the Trial Court was at liberty to proceed with the application for setting aside the ex parte decree. Such instances arose when the appeal was dismissed in default or where it was dismissed as having abated by reasons of omission by the appellant to implead the legal representatives of a deceased respondent or where it was dismissed as barred by limitation. Explanation was added to discourage the two pronged attacks on the decree i.e. by preferring an application to the Trial Court under Order IX, Rule 13 for setting aside the decree and by filing an appeal to the superior Court against it. The legislative attempt incorporating the Explanation to Order IX Rule 13 is to confine the the defendant, to either one of the remedies made available to him and not both. Dismissal of the appeal on any ground, apart from the withdrawal constituted a bar on the jurisdiction of the Trial Court to set aside the ex parte decree. The present revision in hand is continuation of the application under Order 9, Rule 13 C.P.C. submitted by the petitioner Jodharam on 14.8.89. this explanation has been added by C.P.C. After the ex-parte decree was passed against the petitioner Jodharam, he resorted to two remedies.1. and application under Order 9, Rule 13 and 2. appeal against ex-parte decree dated 4.8.89. By two separate orders, the R.A.A. has dismissed both the appeals as mentioned above by orders 8.12.89. The order passed by the R.A.A. on the application under Order 13 does not make any reference to dismissal of the appeal by him against the ex-parte decree However, it is clear that the appeal against ex-parte decree was filed by Jodharam much before the appeal against the order on his application under Order 9, Rule 13 C.P.C. dated 8.9.89. Once the appeal has been dismissed by the R.A.A. on merits of the case after hearing both the parties against the ex-parte decree dated 3.8.89, no application under Order 9, Rule 13 C.P.C. is maintainable in view of the explanation quoted above. A second appeal against the order of the R.A.A. is already pending before the Revenue Board as mentioned above. Atheist after 8.12.89 when the R.A.A. dismissed both the appeals, there is not reason for continuation of the application under Order 9, Rule 13 C.P.C. which is the subject matter of this revision.
