JUDGMENT 1. - The matter has been heard finally with the consent of learned counsel for parties. 2. The only grievance of the petitioner is that although he stood retired w.e.f. September 5, 1974, the arrears of revision of pay and difference of s Gratuity on revision of pension were paid to him after a great delay. Therefore, he is entitled-to interest on the delayed payment. 3. As per undisputed facts the retrial benefits that became due on September 5, 1974 and August 11, 1981 were paid to the petitioner as under:- Amount Due on Paid on (i) Arrears due to revision-fixation of pay Rs. 10,102/- Aug. 11, 1981 1995 (ii) PPO No. 19050 Arrears Rs. 36,060/- Aug. 11, 1981 Sept. 1, 1997 (iii) Gratuity Rs. 7,500 Sept. 5, 1974 1976 (iv) Difference of Gratuity on revision of pension Rs. 3,175/- Sept. 5, 1974 Apr. 26, 1998 4. I have heard the rival submissions and scanned the material on record and I find that the pensionary benefits were withheld by the respondents without valid reasons. Letter dated March 18, 1991 (Annexure- 5) written by District Education Officer (Boys) Ajmer to Director Primary and Secondary Education Bikaner is self expiratory. 5. I, therefore, allow the writ petition and direct the respondents to pay interest(a -) 12% per annum to the petitioner on the delayed payments. The amount of interest shall be calculated from the date the amount due till actual payment was made. The petitioner is also entitled to the costs of writ petition which is quantified as Rs. 2000/- (two thousand). The respondents shall ensure the compliance of the order within sixty days from the date of receipt of copy of this order.Writ Petition Allowed as above. *******
