Judgment 1. Heard counsel for the parties. 2. The petitioner seeks direction upon the respondents to appoint him on the post of police constable in the District of Munger pursuant to advertisement of the year 1997. 3. It is submitted by learned counsel for the petitioner that the petitioner was exHomeguard Jawan and at the relevant time, he was found to be underage and, therefore, he was not considered, but by now he has become eligible for the post of police constable, and, accordingly, his case should be considered by the authority concerned. Learned counsel further submitted that in similar circumstance one Brajendra Kumar and another had moved this Court in C.W.J.C. No. 10997 of 1997 and this Court had directed the respondents concerned vide order dated 27.7.1999 to consider the case of the petitioners. It is also submitted that in light of the order of this Court, as referred to above, the Director General of Police, Government of Bihar, also issued necessary instruction to the concerned authority to consider the case of the eligible persons, but, somehow of the other, case of the petitioner has not been considered till date. 4. In the given facts and circumstances of the case, in my opinion, it would not be appropriate to issue any positive direction in this writ application. However, the petitioner, if so advised, may represent before the respondent concerned ventilating his grievances in light of the order passed by this Court in the aforesaid writ application and the instruction issued by the Director General of Police, Government of Bihar, as referred to above, and, in case, it is so done, the same would be considered by the concerned authority in accordance with law within a period of three months from the date of filing of the representation. 5. With the direction/observation aforesaid, this application is disposed of.
