Judgment 1. The petitioner in this case is a Government contractor. He seeks payment of his contractual dues amounting to Rs. 1,73,887/-. According to the petitioner, he was given the work of restoration of diversion of bridge in 79th KM of N.H. 104 between Sitamarhi and Kumma under agreement no. F2-15. The estimated cost of the work was Rs. 2,21,048/-. It is further stated on behalf of the petitioner that he completed the work in time as provided in the agreement. But out of his final bill the amount claimed by him remains unpaid. He seeks a direction to the concerned authorities for payment of the aforesaid amount alongwith interest as also the refund of his security deposit. 2. As the claim relates to contractual dues, I am not inclined to pass any positive order at this stage. This writ petition is disposed of with the observation that the petitioner may agitate his claim by filing a representation, alongwith a copy of this order, before the Secretary-cum-Commissioner, Road Construction Department, Govt. of Bihar, Patna. In case such a representation is filed within fifteen days from today, the Commissioner-cum-Secretary shall have the petitioners claim duly examined. In case the claim of the petitioner is accepted either wholly or in part, the Commissioner-cum-Secretary shall also take steps for payment of all admitted dues to him without any delay. In case, however, the petitioners claim is rejected, the Commissioner shall pass a speaking order briefly assigning reasons for his decision. An order on the petitioners representation must be passed within two months from the date of its submission and in case any payments are found due, the payment should also be made within four weeks from the date of the order.
