Admittedly, Emanuel Marandi a junior to the petitioner who was given promotion from Class IV to Class III post, was subsequently withdrawn and he was reverted back to Class IV post, on the representation of the petitioner and, therefore, the ground of discrimination raised by the petitioner in this writ application is not valid. 3. However after the Government decision dated 5.12.1995, promotion from Class IV to Class III can be only through the Bihar Public Service Commission and, therefore, I find no illegality in the order as contained in Annexure-5, whereby the claim of the petitioner for promotion on the basis of Seniority has been rejected. 4. Accordingly, this application is dismissed having no merit.
