Judgment 1. Heard learned counsel for the petitioner. 2. This criminal revision application is directed against the order dated 2.8.2003 passed by the trial Court rejecting the prayer of the petitioner to declare him as juvenile on the ground that on the date of production he was not a juvenile. 3. It has been held by three judges Bench of the Supreme Court in the case of Umesh Chandra V/s. State of Rajasthan, reported in (1982)2 Supreme Court Cases 202 that the crucial date to decide that a person is a juvenile is the date on which the offence was committed and not the date of trial. 4. In that view of the matter, the impugned order is set aside and the matter is remitted to the Court below to consider in the light of the observations made above. 5. In the result, the criminal revision application is allowed.
