Judgment 1. Heard counsel for the parties. 2. The grievance of the writ petitioner is that though he had appeared in the test held as per advertisement no. 167 of 1996, his result was not published. 3. It appears that two posts of Turner Instructor were advertised earlier in the year 1990. The petitioner is said to be one of the applicants pursuant to that advertisement. However, examination could not be conducted pursuant to the advertisement of the year 1990 and thus, the posts remained vacant and they were again advertised by advertisement no. 167 of 1996. In this advertisement. stipulation was made that the candidates, who had applied pursuant to the advertisement of the year 1990, may also appear in the test held by the Bihar Public Service Commission (hereinafter to be referred to as "Commission"). The petitioner, accordingly, appeared in the test held by the Commission, where he had not been shown as successful candidate. 4. It is stated by learned counsel for the petitioner that number of posts could have been increased giving full opportunity to the petitioner and other eligible persons. Further a grievance has also been made by learned counsel for the petitioner that the petitioner had reasons to believe that he was successful in the examination, but his result was not published. 5. On own showing of the petitioner, it appears that the result pursuant to advertisement no. 167 of 1996 was published in Hindi daily newspaper "Aryavart" on 18th March, 1999, in which the name of the petitioner was not shown as one of the selected candidates. 6. Results of the successful candidates are published and since the petitioner was not a successful candidate, his result might not have been published, and, therefore, no grievance can be made by the petitioner. 7. Considering the facts and circumstances of the case and for the reasons aforementioned, therefore, I do not find any merit in this application. 8. This application is, accordingly, dismissed.
