Judgment 1. Heard learned counsel for the petitioner and the learned Counsel for the State as well as the learned counsel appearing for the Accountant General and perused the record. 2. Learned counsel for the petitioner submits that the grievance of the petitioner has now been redressed except that no payment of interest on delayed payment of retiral dues has been paid. 3. In the absence of statutory provision, this Court does not feel inclined to issue any direction for payment of interest. However, in view of the Government circular, bearing no. 3155 dated 7.11.1981, a Government servant is entitled for interest on delayed payment of pension and gratuity in the circumstances mentioned therein. Accordingly, the petitioner may approach the authority concerned for payment of interest in terms of the said Government circular, whereupon the concerned authority shall consider the same and issue sanction order for payment in terms of the said Government circular. 4. Learned counsel for the petitioner submitted that although no claim for commutation of pension has been made in the writ petition, but the fact remains that despite request made by the Accountant General to the State authorities, sanction order for commutation of pension has not been issued. 5. Accordingly, this Court directs, the Commissioner and Secretary, Labour, Employment and Training Department, Government of Bihar, Patna (respondent no. 3) to ensure completion of all formalities with regard to commutation of pension of the petitioner within two weeks of the receipt/ production of a copy of this order. 6. The writ application is, thus, disposed of.
