Jagganath Thakur v. State Of Bihar

2005-11-24

BARIN GHOSH

body2005
Judgment 1. Heard. 2. One of the grounds upon which the revision was filed, was that the Executive Magistrate passed the order, by which he directed appointment of Receiver, without giving any notice to the petitioner. This aspect of the matter was highlighted before the Revisional Authority. The Revisional Authority proceeded on the basis, as if, the Original Court which passed the order heard both sides. 3. On that ground alone, the Revisional Order is set aside. The matter is remitted back to the Revisional Court and the Revisional Court is directed to pass fresh order in accordance with law. 4. This disposes of the application.
