Judgment 1. Learned cauncel for the petitioner is permitted to add the Director, Secondary Education, Government of Bihar, Patna, as respondent no. 7 in this application. 2. Heard counsel for the parties. 3. This relates to payment of retiral dues to the petitioner, who retired as headmaster of a High School in the year 2002. 4. It is submitted by learned counsel for the petitioner that during the pendency of this application group insurance amount and GPF amount have been paid to the petitioner, but the State authorities have not finalised his pension nor the gratuity amount has been paid to him. 5. A counter affidavit has been filed on behalf of respondent no. 4, wherein it is stated that final pension is to be finalised by the Director, Secondary Education, Government of Bihar, respondent no. 7 and at the same time, he is the competent authority to sanction gratuity amount payable to the petitioner. It is also stated that the deponent has already forwarded the relevant records to the Director, Secondary Education, Government of Bihar for finalisation of pension and payment of gratuity amount to the petitioner. 6. Considering the facts and circumstances of the case, respondent no. 7, Director, Secondary Education, Government of Bihar, is directed to pay the full pension and gratuity amount due to the petitioner within a period of six week from the date of receipt/production of a copy of this oder. 7. This order is being passed on the assumption that till date pension of the petitioner has not been finalised and he has not been paid his gratuity amount. 8. With the direction/observation aforesaid, this application is disposed of.
