Judgment 1. Heard learned counsel for the parties. 2. The petitioner is aggrieved by the order dated 21.9.2004, whereunder prayer to release the motorcycle in question was refused on the ground that the said motorcycle was used for committing offence under Section 392 of the Penal Code as also on the ground that the investigation was still in progress. 3. Learned counsel for the petitioner contends that during pendency of this petition investigation has been completed and the police has found the ease to be false and accordingly submitted final form dated 18.4.2005. He has also informed this Court that the informant has no objection if the vehicle in question is released in favour of the petitioner. 4. Let the aforesaid aspects of the matter be reconsidered by the CJM, Patna and if it is found that the final form has been submitted in the case and the informant has no objection to the prayer for release of motorcycle in favour of the petitioner, the vehicle (motorcycle) be re-leased in favour of the petitioner. 5. The petition stands disposed of with the aforesaid observations and directions.
