Judgment Mehtab S.Gill, J. 1. Prosecution case, in brief, is that on 6.4.1994 appellant Anand was arrested by Sub Inspector Satbir Singh in case FIR No. 51 dated 27.3.1994 under Sections 302, 353, 186, 187, 188 and 120-B of the Indian Penal Code and Sections 25 and 27 of the Arms Act. He was interrogated in the presence of Constable Baljeet Singh and one Vishnu Dutt. He made a disclosure statement, Ex. PC, that he had handed over the revolver of Assistant Sub Inspector Mohinder Singh to his co-accused Virender. He had kept concealed four live cartridges in the corner of his residential house. Accused Anand got the four live cartridges (Ex. P-1 to Ex. P-4) recovered from his house, as pointed out by him on 7.4.1994, in the presence of Sub Inspector Satbir Singh, Head Constable Ramphal and Bhagwana (PW-3). 2. Prosecution, to prove its case, brought into the witness box, Sub Inspector Maan Singh (PW-1), Assistant Sub Inspector Rajinder Singh (PW-2), Bhagwana (PW-3) and Sub Inspector Satbir Singh (PW-4). 3. Learned counsel for the appellant-State has argued, that the testimony of Sub Inspector Satbir Singh (PW-4) is cogent and convincing. He stated that, during the course of interrogation in a case FIR No. 51 dated 27.3.1994, in the presence of Constable Baljeet Singh and Vishnu Dutt, appellant made a disclosure statement, Ex. PC. Learned counsel for the appellant-State has stated, that the testimony of the sole witness brought, Sub Inspector Satbir Singh (PW-1), before whom the disclosure statement was made, is cogent and convincing. 4. We have heard the learned counsel for the parties and perused the record with their assistance. 5. No explanation has come forward, as to why Head Constable Baljeet Singh and Vishnu Dutt, the independent witnesses, to the disclosure statement, Ex. PC, were not examined. It is difficult for us to convict respondent-accused Anand on the sole testimony of Sub Inspector Satbir Singh (PW-1). Though, one Bhagwana (PW-3) was examined, but he was not a witness to the disclosure statement, Ex. PC. Bhagwana (PW-3) is a close relative of Assistant Sub Inspector Mohinder Singh. He is the uncle of the deceased and lives 80 Kms away. 6. We do not find any infirmity in the judgment dated 8.2.1997 passed by Additional Sessions Judge, Sonepat. Appeal is dismissed.
