body2005
Judgment :- Markandey Katju, C.J. This writ appeal has been filed against the impugned order of the learned single Judge dated 17.8.2001 passed in Writ Petition No.15492 of 1995. 2. Heard Ms. K.Suguna, learned counsel for the appellant and perused the record. 3. The appellant was a driver of the Gandhigram Rural University and he was charged for misbehaviour and shouting at women staff of the institute while on official duty under the influence of alcohol. An enquiry was held in which he was found guilty and thereafter he filed the writ petition which has been dismissed. The finding of guilt is a finding of fact and we cannot interfere with it in writ jurisdiction. 4. It may be mentioned that being under the influence of alcohol while on duty is a serious misconduct. Apart from that, the appellant while under the influence of alcohol misbehaved and shouted very rudely towards women staff of the institute while on official duty. Such a misbehaviour cannot be condoned. We see no reason to interfere with the impugned order. The writ appeal is dismissed.
