ORDER Sujata Das, FC. - This is a revision petition under Section 16 of the Punjab Land Revenue Act, 1887, against the order dated 24.9.2002, passed by Commissioner, Jalandhar Division, Jalandhar and against the order dated 29.11.2001 passed by District Collector, Hoshiarpur. 2. This revision is regarding Lambardari of Village Palaki Tehsil Mukerian, District Hoshiarpur. On the demise of the previous Lambardar, applications were invited and four candidates applied for the post. However, only two candidates appeared before the District Collector. After considering merits and demerits the Deputy Commissioner appointed Karam Chand as the Lambardar of the Village. In appeal, it was observed by the Commissioner that Som Raj appellant had Karyana shop in the village, so he would not be able to spare time for the general public and as such the Commissioner upheld the orders of the Deputy Commissioner. 3. Grounds of revision before this Court are that respondent is an illiterate person and the office of Lambardar is not a reward but involves duties like crime detections etc. The petitioner has stated that there is no evidence on record to show that Karam Chand, respondent is second class pass and his age is not 65 years but 80 years as is evident from the voter list. And the Deputy Commissioner in his order has mentioned his age as 32 years while appointing him as Lambardar. Some where else in the order, he has mentioned his age as 65 years. The second ground taken in the revision is that the petitioner Som Raj is the son of the previous Lambardar of the village. 4. Considering of the above facts, I am of the view that Som Raj should be appointed as Lambardar as he is ninth class fail; he owns land and Pacca house. He is a much better candidate than Karam Chand who is illiterate. Accordingly, the revision petition is accepted. Announced. Petition allowed.
