Judgment 1. Heard counsel for the parties. 2. This pertains to payment of arrears of salary to the petitioner. 3. It is submitted by learned counsel for the petitioner that the petitioner is Vice Principal of C.M.J. College, Donwari Hat, in the District of Madhubani, and his arrears of salary for the period in between 1.1.1986 and 30.6.1996 have not been paid. 4. In this case, counter affidavits have been filed on behalf of the University and the State. 5. In the counter affidavit, the respondent University acknowledges the arrears of salary of the petitioner for payment to the tune of Rs. 2,86,515/-. 6. It is submitted by Mr. Partha Sarthy, learned counsel for the University, that recently, vide letter dated 16.11.2005 the University has been intimated by the State Government that a sum of Rs. 2,86,515/- is payable to the petitioner, for which necessary fund has been released in favour of the University. 7. The claim of the petitioner for making payment of the amount to the tune of Rs. 2,86,515/- is not in dispute. It is also not in dispute that the fund now has been made available by the State Government to the University for making necessary payment to the petitioner and other teachers as well. 8. Regard being had to the facts and circumstances of the case, as referred to above, the University authorities are directed to ensure payment of arrears of salary to the petitioner to the tune of Rs. 2,86,515/- within a period of four weeks from the date of receipt/production of a copy of this order. 9. This order is being passed on the assumption that the State Government has already released the fund in favour of the respondent University for making payment of necessary dues to the petitioner. 10. With the direction/observation aforesaid, this application is disposed of.
