Judgment Ajay Rastogi, J.-This writ petition was filed with the grievance that despite the petitioner having qualified service of more than 15 years on the post of Patwari, his candidature has not been considered for grant of selection scale w.e.f. 01.09.1988 in view of circular dated 23.09.1989 issued by the respondent. 2. During pendency of writ petition, respondents have filed reply to writ petition stating inter-alia that vide order dated 20.05.1995 after one year w.e.f. 01.09.1988, selection scale was granted to petitioner and it was deferred for one year for the reasons that petitioner was inflicted with penalty of stoppage of one annual grade increment with cumulative effect vide order dated 06.08.1988. 3. Having considered rival contentions and material on record, I find that the petitioner has neither amended his writ petition nor he has challenged the order dated 20.05.1995, by which selection scale has been granted to him in pursuance of order dated 23.09.1989. In this view of the matter, once selection scale which is sought for in this writ petition, has been granted to the petitioner, nothing remains further to be adjudicated upon, hence this writ petition, has become infructuous and consequently it is hereby dismissed. No order as to costs.
