JUDGMENT 1. - The petitioner submitted an application for shifting the 'Kutri Khala' from point 'B' to point 'C' mentioned in Map Annexure-1 to a regular 'Khala' on the same line from point B 1' to 'C'. The application submitted by the petitioner was accepted by the Divisional Irrigation Officer by the order dated 31.7.1992. 2. An appeal was preferred before the Superintending Engineer challenging the order dated 31.7.92 by the son of person aggrieved. The appeal so preferred was decided by order dated 19.5.93 by the Superintending Engineer setting aside the order dated 31.7.92. The petitioner challenged the validity of the order dated 19.5.93 passed by the Superintending Engineer by way of filing a second appeal before the Chief Engineer. The Chief Engineer though entertained the appeal but no interim order was granted in favour of the petitioner. Being aggrieved by the same the petitioner preferred the present writ petition before this Court. 3. It is an admitted fact between the parties that the appeal preferred before the Chief Engineer is still pending. 4. Looking to all the facts and circumstances of the case, it shall be appropriate to dispose of this writ petition with a direction to the Chief Engineer (Irrigation) North Division, Hanumangarh, where the appeal is pending to decide the appeal on merits within a period of four weeks from the date of submitting a certified copy of this order by the petitioner. Till then the position existed today shall be maintained. 5. No orders as to costs.Petition disposed of. *******
