Judgment V.K. Bali, J.-Pursuant to the order issued by this Court dated 13.04.2005 Mrs. Rashi Singh, is present in the Court and her statement has been separately recorded. 2. It has been the case of the petitioner Mohit Gehlot that he was married with Mrs. Rashi Singh on 22.03.2005 and thereafter, Mrs. Rashi Singh started living with him. In proof of the marriage, the petitioner Mohit Gehlot has placed on record a photostat copy of the joint affidavit of himself and also his wife dated 21.03.2005 and a Certificate bearing No.06/05 dated 22.03.2005 issued by Arya Samaj, Indira Gandhi Nahar Pariyojana, Lalgarh, Bikaner, Rajasthan. It has further been the case of the petitioner that all of a sudden on 31.03.2005 the father of Respondent No.4 Mrs. Rashi Singh namely; Dr. D.N. Singh, came to the house of the petitioner and took her forcibly. It is further averred that Mrs. Rashi Singh wants to live with the petitioner as his legally wedded wife but the Respondent No.5 is not permitting her to do so. 3. In view of the statement made by Mrs. Rashi Singh, it is quite apparent that she is an adult being above the age of 18 years and had married with the petitioner on her own volition without any pressure from any quarter whatsoever. She wants to live with her husband (the petitioner herein) and does not want any interference in her married life form anyone including her parents. 4. From the pleadings made in the petition and also the statement made by Mrs. Rashi Singh, this Court is of the firm view that Mrs. Rashi Singh wants to live with Mr. Mohit Gehlot being married to him. She is indeed not happy to live with her parents who as per her statement are interfering with her married life. Without commenting upon the illegal confinement of the Respondent No.4 by her parents and particularly, her father, the Vth respondent herein, we order that Mrs. Rasih Singh will be free to go with her husband Mr. Mohit Gehlot right from the Court premises. We further direct that none including Respondents No.5 would interfere with the married life of the petitioner and his wife Mrs. Rashi Singh.

The petitioner and his wife would be accompanied by a responsible Police Officer to be deputed by the Superintendent of Police (South), Jaipur City, Jaipur who would ensure safe travelling of the petitioner and his wife Mrs. Rashi Singh at the house of the petitioner. At no time, any one including the father of Mrs. Rashi Singh would try to interfere in the married life of the petitioner and his wife Mrs. Rashi Singh. Any complaint that may be filed by either of them shall be entertained and action shall be taken thereon. It will be open to the petitioner and his wife Mrs. Rashi Singh to move any misc. application in this matter, in case, anyone of them might feel any interference from the father of Mrs. Rashi Singh or any one else. 5. The petition is disposed of with the observations/directions made above. Mrs. Rashi Singh respondent No.4 is present in Court. Let her statement be recorded. I, Rashi Singh wife of Mr. Mohit Gehlot, Father Name Dr. Deoki Nandan Singh, aged about 18 years and 8 months. Presently residing with Respondent No.5 Dr. D.N. Singh, R/o Acharya Colony, Tera Ghat, Nalanda, Dist. Nalanda (Oath administered). I was married with Mr. Mohit Gehlot, the petitioner in this case on 22.03.2005 in accordance with the custom of Arya Samaj and thereafter, I started living with the petitioner. My father took me with him at the address given above. I am happily married with the petitioner and I want to live with him only. I am an adult and have married with my own volition and without any pressure from any quarter whatsoever. I do not want interference in my married life even from my parents side. I want to go with my husband Mr. Mohit Gehlot right from the Court premises.
