Judgment Govind Mathur, J.-By this writ petition, challenge is given by the petitioner to the order dated 29th July, 2002 passed by the appropriate Government refusing to refer the Industrial Dispute for adjudication to the competent Labour Court/Industrial Disputes Tribunal under the Industrial Disputes Act, 1947. 2. Challenge is also given by the petitioner to the order dated 31st July, 2002 passed by the appropriate Government refusing an another dispute pertaining to the petitioner for its adjudication to the competent Labour Court/Industrial Disputes Tribunal. 3. I have perused the orders referred above, therefrom, it is apparent that the appropriate Government has entered into the merits of the dispute and on that ground, refused to refer the same for adjudication. It is well settled that the appropriate Government while considering the dispute for making reference, is not required to enter into the merits of the disputes as the same is the domain of the adjudicating authority under the Act of 1947. 4. In view of the above, the orders impugned 29.07.2002 and 31.07.2002 passed on behalf of the appropriate Government are hereby quashed. The appropriate Government is directed to make reference of the disputes to the competent Labour Court/Industrial Disputes Tribunal. 5. No order as to costs.
