Judgment ( 1 ) IA No. 4 in WP (C) No. 353 of 2005 is allowed as not opposed. The additional grounds P to W as set out in the application are permitted to be urged as grounds in the main petition in support of the relief sought for. ( 2 ) THE respondents are yet to file their counter-affidavit. Let it be done in two weeks as prayed. Counter shall be to the main petition as also to the additional grounds sought to be urged through IA No. 4 of 2005. For the purpose of record a copy of the amended petition incorporating additional grounds P to W shall be filed by the petitioner within three days under copy to the respondents counsel. IA No. 3 in WP (C) No. 353 of 2005 ( 3 ) THE prayer for deleting Respondent 2 from the array of parties and also paras 13, 14 and 17 of the writ petition is allowed. The amended petition which is being filed within three days shall also take care of the prayer made in IA No. 3. IA No. 2 in WP (C) No. 353 of 2005 (for stay) ( 4 ) THE learned counsel for the parties state that looking to the constitutional issues arising for decision in the petition the matter needs to be heard by a Constitution Bench. months of August and September, and therefore, it is likely that the election may be held in the month of October or November 2005. ( 5 ) LET the petition itself be listed for hearing in the month of September 2005. If the matter is not heard by 19-9-2005, IA No. 2 shall be listed for directions. No orders for the present. ( 6 ) LEARNED counsel for the parties are requested to file brief synopsis of their respective submissions and the list of authorities relied on in one week.
