ORDER S.J. Mukhopadhaya, A.C.J. 1. According to petitioner, he was in the services of the Jharkhand State Electricity Board (hereinafter it shall be referred to as J.S.E.B. for short) and retired on 31.01.2002 from the post of Electrical Executive Engineer, Electric Supply Division. Giridih. It is stated that he has been paid provisional pension but the other benefits have not been paid including arrears on finalization of pension, gratuity, commuted value of pension, leave encashment etc. While in service, a departmental proceeding was initiated against him which was concluded after his retirement in the year 2003 in which he was exonerated. 2. Learned counsel for the J.S.E.B. submitted that it is to be find out whether the petitioner has been actually exonerated in the departmental proceeding or not and what benefit to which he is entitled, if he was in the services of the J.S.E.B. 3. In the facts and circumstances, the case is remitted to the Secretary, J.S.E.B., Engineering Building, HEC, Dhurwa, Ranchi who in his turn, will determine the claim and pay the admitted retrial benefits to the petitioner, if found payable, within three months from the date of receipt of representation failing which the respondents shall be liable to pay interest at the rate of 5 per cent on the admitted retrial benefits from the date of retirement till the amount is paid to the petitioner. 4. On the other hand, if the authority disputes the claim or part thereof will communicate the grounds to the petitioner. 5. The writ petition stands disposed of with the aforesaid observations/directions.
