ORDER S.J. Mukhopadhaya, A.C.J. 1. According to the petitioner, he was in the services of the Jharkhand State Electricity Board and retired on 28th February, 2002 from the post of Technician-I, Group-A from Patratu Thermal Power Station Patratu, Hazaribagh. 2. The grievance of the petitioner is that though the respondents have sanctioned certain amount such as Leave Encashment vide Office Order No. 2730/ Patratu, dated 25th September, 2002 and other benefits like gratuity, provident fund etc., but the retirement benefits have not be paid to him. It is stated that the petitioner has already vacated the Quarters on 23rd August, 2003. 3. Having heard the counsel for the parties, as the matter firstly requires consideration by the respondents, instead of giving decision on merit, I direct the General Manager-cum-Chief Engineer, Patratu Thermal Power Station, Patratu, Hazaribagh to decide the claim. 4. If any amount is found payable towards retiral benefits, such as, pension, gratuity, leave encashment, G.P.F., G.S.S. etc. and other benefit like arrears of salary, the authority will pay such admitted dues, within a period of three months from the date of receipt/production of a copy of this order. However, it will be open to the respondents to adjust the House Rent, Electricity Charges etc., if found payable. 5. If the admitted retiral benefits are not paid within the period of three months, ad indicated above, the respondents will be liable to pay interest @ 5% from the date the petitioner vacated the Quarters. 6. It will be also open to the petitioner to represent against the order of penal/ market rent. If any such representation is filed, the General Manager- cum-Chief Engineer concerned will pass appropriate order within the aforesaid period of three months from the date of receipt of representation/or production of a copy of this order. 7. On the other hand, if the authority rejects claim or part thereof, will communicate the ground to the petitioner. 8. The writ petition stands disposed of with the aforesaid observations and directions.
