ORDER : 1. I.A. No. 1/2005 in C.A. No. 4546/2005 seeks stay on the Panchayat elections in the State of Uttar Pradesh. The elections have been notified on 20th September, 2005. The polling is to be completed between 14th October, 2005 and 23rd October, 2005. The learned counsel for the applicants has vehemently contended that there are several illegalities and to certain extent constitutional provisions have been violated. 2. Be that as it may, we are not inclined to stay the process of election midway. Let the election process go on and be completed. To protect the interest of the appellants-applicants, it is directed that the results of the election shall be subject to the result of this appeal. Hearing of the appeal is expedited. Liberty to mention. 3. The learned senior counsel for the petitioners states that the issue arising in this petition is identical with the issue of which this Court is seized in WP(C) No. 356/1994 etc. etc. which has been directed by a Constitution Bench to be heard by a larger Bench. 4.
