Judgment :- (Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus as stated therein.) P. Sathasivam, J. By consent of both the parties, the main Writ Petition itself is taken up for disposal. 2. The petitioner has approached this Court to issue Writ of Mandamus forbearing the respondents herein, their men, agents, subordinates or any one claiming under them from in any manner demolishing or removing the super structure of the temple situate at T.S.No.106, Chokkalingapuram Devangar High School Road @ East Car Street being Arulmighu Poomariamman Temple premises situate therein at Aruppukkottai Town, otherwise than by due process of law. 3. The Commissioner/the first respondent herein has filed a counter affidavit. In paragraph 8, the Commissioner has stated that without proper notice, the municipality will not take any action in demolishing the Temple. 4. In the light of the information and in view of the law laid down by the Full bench of this Court in Ramaraju vs. The State of Tamil Nadu, rep. by its Secretary to Government, Revenue Department and others [ 2005(2) CTC 741 ], we are of the view that no direction is required except observing that, action would be taken in accordance with law. The Writ Petition is disposed of accordingly. No costs. Consequently, WPMP No.3270 of 2005 is closed.
