JUDGMENT 1. - Heard learned counsel for the accused petitioner as well as learned Public Prosecutor.The accused is facing trial in a case of electricity theft. He did not appear before the trial court on 10.5.1993 and surrendered before the court on 13.6.2005. 2. Learned counsel for the petitioner has contended that the petitioner had gone to abroad for earning livelihood therefore, he could not appear in the case and now he will not commit any default in future. It is also contended that the petitioner himself has surrendered before the trial court on 13.6.2005. 3. Learned PP although has opposed the bail application.Having considered the nature of allegation, the fact that petitioner himself surrendered before the trial court and taking into consideration the entire facts of the case but without expressing any opinion on the merits of the case, I consider it proper to release the accused petitioner Salim on bail under Section 439 Cr.P.C. in Criminal Case No. 360/1990 pending before the Additional Judicial Magistrate No. 1, Sikar provided he furnishes a personal bond in the sum of Rs. 20,000/- together with one surety in the like sum to the satisfaction of the learned trial court for his appearance before that court on all subsequent dates of hearing and as and when called upon to do so.Bail allowed. *******
