JUDGMENT 1. - Heard learned counsel for the petitioners as well as the Public Prosecutor for the State assisted by counsel for the complainant. Perused the order impugned. 2. Learned counsel for the petitioners submits that Laxmi Narain, husband of complainant has left the house with a note that since a false case has been registered and, therefore, he has left the house. Laxmi Narain is not traceable according to the learned counsel for the petitioners, the dowry articles alleged to have been given to the complainant by her parents are lying in a room of Laxmi Narain under lock and key. However, the petitioners are prepared to return the dowry articles to Investigating Officer. An application has been filed by them to the SHO as also to be Superintendent of Police for taking over the dowry articles but they did not receive. The petitioners are prepared even now to return the dowry articles. 3. Keeping in view the submissions made by the learned counsel for the petitioners, I think it just and proper to direct the petitioners to return the dowry articles to the Investigating Officer within a week and if the petitioners return the dowry articles, the Investigating Officer shall receive the same and hand over the same to the complainant if she wishes to receive them. 4. Till 13.7.2005 in the event of arrest of petitioners Kishan Lal and Manoj Kumar, they be released on bail in FIR No. 225 of 2005, P.S. Nokha, Bikaner provided each of them furnishes a personal bond in the sum of Rs. 10,000/- with a like amount to the satisfaction of the Investigating Officer with the following conditions: (i) That they shall make themselves available for interrogation by a police officer as and when required; (ii) That they shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police office and; (iii) That they shall not leave India without the previous permission of the Court. 5. 1st the case diary be returned to the I.O. with a direction to resubmit the same on or before 14.7.2005. 6. List the matter on 14.7.2005.Bail application allowed. *******
