Judgment 1. Heard learned Counsel for the appellants. 2. After taking the evidence on record, Labour Court found that husband of appellant No. 1 does not come within the definition of “workman” and the Labour Court passed the award in favour of the management. 4. In petition before learned Single Judge, the learned Single Judge has also affirmed the view taken by the Labour Court. 5. Learned Counsel for the appellants submits that the husband of the appellant No. 1 did come under the definition of “workman”, therefore, he is entitled for any relief under the Industrial Disputes Act. 6. Learned Counsel further submits that the nature of duty of husband of the appellant No. 1 was not supervisory, but he was drawing more than Rs. 1,600/-pay per month. 7. 6. The definition of “Workman” has been given in Sub-section (s) of Section 2, which reads as under:-“workman” means any person (including an apprentice) employed in any industry to do any manual, unskilled, skilled, technical, operational, clerical or supervisory work for hire or reward, whether the terms of employment be express or implied, and for the purposes of any proceeding under this Act in relation to an industrial dispute, includes any such person who has been dismissed, discharged or retrenched in connection with, or as a consequence of , that dispute, or whose dismissal, discharge or retrenchment has led to that dispute, but does not include any such person- .(i) who is subject to the Air Force Act, 1950 (45 of 1950), or the Army Act, 1950 (46 of 1950), or the Navy Act, 1957 (62 of 1957); or .(ii) who is employed in the police service or as an officer or other employee of a prison; or (iii) who is employed mainly in a managerial or administrative capacity; or (iv) who, being employed in a supervisory capacity, draws wages exceeding one thousand six hundred rupees per mensem or exercises, either by the nature of the duties attached to the office or by reason of the powers vested in him, functions mainly of a managerial nature.” 8. While considering the nature of work and scale of pay, the Labour Court has considered this aspect in Paras 8-9 of its order and finally come to the conclusion that husband of the appellant No. 1 did not come under the definition of “workman”. Clause (iv) of Sub-section (s) of Section 2 provides that if any employee employed in his supervisory capacity draws wages exceeding one thousand six hundred ruppes per mensem or exercises, either by the nature of the duties attached to the office or by reason of the powers vested in him, functions mainly of a managerial nature. He does not come under the definition of “workman”. 10. When there is finding of the Labour Court and that has not been disturbed by learned Single Judge and that finding of fact is not perverse that the husband of the appellant No. 1 was drawing more than Rs. 1,600/-wages and his duties were supervisory in nature, even he was promoted to the post of Supervisor in 1987, we see no substance in this appeal. 12. However the liberty is given to the appellants to approach to the concerned authority for payment of gratuity within three weeks. 13. If the appellants approach the concerned authority within three weeks, the concerned authority is directed to dispose of that representation in accordance with law. 14. The appeal stands dismissed with the above directions.
