ORDER : H.K. Sema, B.N. Srikrshna, JJ. Leave granted. 2. Heard the parties. 3. The respondents were put to notice and are represented by the counsel. The appellant is aggrieved by an order of the High Court of Uttaranchal at Nainital dated 21-5-2004 particularly directing the appellant to deposit a sum of Rs. 15,000 which is a condition precedent for setting up a committee to go into the allegations of illegal mining and unauthorised encroachment of Government land in the city of Rudrapur, Udham Singh Nagar. 4. Having regard to the fact that unauthorised occupation of the Government land has been admitted by the respondents, we see no reason as to why the appellant was directed to deposit a sum of Rs. 15,000 as a condition precedent for the constitution of the committee. The impugned order to the extent of depositing Rs. 15,000 is set aside. Let the committee appointed by the Court to go into the entire issue and submit the report to the High Court. The High Court shall revive Writ Petition No. 546M/B of 2003 and dispose of the same after the receipt of the report submitted by the committee in accordance with law. 5. The appeal is disposed of accordingly.
