ORDER 1. According to the counsel appearing for the accused-petitioner a criminal case could not be dismissed for non-prosecution. 2. Limited notice be issued to the respondent as to why the impugned order be not set aside and the case remitted back to the High Court for a fresh decision, in accordance with law, after hearing either the accused or his counsel. 3. Since the High Court had stayed the proceedings of the trial court during the pendency of the revision petition, we direct that the proceedings before the trial court shall remain stayed until further orders.
