Judgment V.K. Bali, J.-This Court took suo moto cognizance of the Newspaper item appearing in The Hindu dated March 18, 2004 pertaining to two lady Lecturers of the Government College, Banswara, which appeared to be a punishment for taking up cudgels with their male colleague. Order treating letter to be a petition and issuing notice to the concerned respondents on 19.03.2004 reads as follows:- "A news item has appeared in The Hindu" dated March 18, 2004. According to the news item, two lady Lecturers of the Government College, Banswara have seemingly been punished with transfer to Jaisalmer and Dholpur for taking up cudgels with their male colleague, a Lecturer in English Literature working in the same college. According to the newspaper report, the lady Lecturers were being harassed by the aforesaid male Lecturer. It is also pointed out in the newspaper report that in the State of Rajasthan, Grievance Committee in the Government Departments and institutions to take up the matters relating to sexual harassment of working women have not been constituted. .2. Having regard to the newspaper report, we deem it proper to issue suo moto notices to the following:- 1. The State of Rajasthan through the Chief Secretary. 2. The Secretaryto Government Education Department, Government of Rajasthan, Jaipur. 3. The Director, College Education, Rajasthan, Jaipur. 4. Principal, Government College, Banswara. 3. We order accordingly. 6.4. Mr. Bharat Vyas, learned Additional A.G. accepts notices. 7.5. List the matter on 15.04.2004." 6. The order dated 16.04.2004 passed by the Bench would reveal that three enquiries have since already been conducted. The learned Additional Advocate General on the basis of documents placed on record informs the Court that a Grievance Committee for taking matters of women regarding sexual harassment has since already been constituted on 08.04.2003 pursuant to the directions issued by Honble Supreme Court in Vishakha vs. State, reported in 1997 (2) JT 384. He further informs the Court that the matter is already before the Grievance Committee so constituted, even though, final report has not been submitted by the said Committee due to the pendency of the present petition. He also informs the Court that after considering all these matters the Honble Bench then seized of the matter vide order dated 17.05.2004 ordered that the Commissioner of College Education, should examine the matter and give his report. The learned Commissioner has already submitted his report on 31.05.2004.

In so far as, the lady lecturers mentioned in News item are concerned, they have since already been transferred to Banswara. 7. We are of the considered view that the grievances made out in the News item have since already been redressed. No further orders are required to be passed in this case. 8. The learned Counsel for lady lecturers however, contends that the Grievance Committee should give its report which is not given as yet only on account of pendency of the present petition. Mr. Bharat Vyas, learned Additional Advocate General does not oppose the prayer of the Counsel for the petitioner. 9. In view of the statement made by the learned Counsel, as noted above, we only direct that the Grievance Committee shall take the complaint of the lady lecturers to its logical ends and give its final report within a period of three months from the date it receives a copy of this order. The Grievance Committee, we are sanguine while arriving at any conclusion, shall also examine various reports which have been submitted inclusive of report submitted by the Commissioner.
