JUDGMENT 1. - Heard learned counsel for petitioner Rupendra Singh, learned Public Prosecutor for the State and perused the relevant documents placed before me including the statement of the prosecutrix recorded under Section 164 Cr. P.C. wherein she has levelled allegation of rape by the petitioner with her.It is inter-alia contended that the prosecutrix is a married lady and was a consenting party as is evident from her conduct of regularly going with the petitioner and returning either on the next day or after a day or two to the house of her husband. 2. Learned Public Prosecutor has opposed the bail application on the ground that the prosecutrix has levelled the allegation of rape against the petitioner. 3. Without expressing any opinion on the merits of the case at this stage but considering the nature of accusation, the materials on record and all other facts and circumstances of the case, I deem it just and proper to enlarge him on bail. 4. In the result, the bail application is allowed, and it is directed that petitioner Rupendra Singh son of Sumeer Singh shall be released on bail in FIR No.69/2005 P.S. Losal, Distt. Sikar registered for offences under Sections 376, 323 and 382 I.P.C. on his furnishing a personal bond in the sum of Rs. 20,000/- together with one surety in the like amount to the satisfaction of the concerned Court for his appearance before that. court on all dates of hearing until conclusion of the trial.Bail allowed. *******
