The petitioner society consists of members/land owners from different parts of Manipur. The simple case of the petitioner is that agricultural lands belonging to the members of the petitioner society had been inundated beyond any use as a consequence of the implementation of the Loktak Hydro Electric Project at Komreirap/Leimatak. The fertile paddy fields of the petitioner association, the particulars of which are given above, can no longer be used for agricultural purposes as a result of the commission of the Loktak Hydro Electric Project. In spite of repeated request from the side of the members of the petitioner association not only to the authority of the Loktak Hydro Electric Project but also to the concerned authority of the Govt of Manipur for payment of compensation for causing damage to the paddy fields of the petitioner's members mentioned above of the commission on the Loktak Hydro Electric Project, no action was taken up either from the authority of the Loktak Hydro Electric Project or from the competent authority of the Govt. of Manipur. 4. of Manipur. 4. Learned counsel for the petitioner further submits that in the year 1992, when matters for payment of compensation to the land owners of the affected area on the Commission of the Loktak Hydro Electric Project was the issue of the public,by way of eye wash or in order to cool down the public hue and cry, constituted a House Committee of the Manipur Legislative Assembly to examine the amount of compensation for the affected areas. The committee in its sitting held on 08.12.1992 had directed the Commissioner (Revenue) to the Govt of Manipur vide letter No. 2/5/92-LA/CHC (Comp) dated 22.12.1992 to submit the following informations:- (i) Total area affected by the Loktak Project; (ii) Land available for settlement in Loktak Areas before 1964-65 and Lands granted settlement in the area after 1964-65. (iii) District-wise details of the lands affected by the project and lands covered by Loktak Water. (iv) Total patta lands affected by the Loktak Project in the Districts of Thoubal, Bishnupur and Imphal. (v) Acutal land covered under the agreement between the State Govt. and Project authority for the project. 5. Learned counsel for the petitioner further submits that because of the expiry term of the members of the House Committee and also because of changed of Ministry, the House Committee constituted to examine the amount of compensation for the affected areas could not complete the inquiry. As a result of the above the problem, the members of petitioner association had been suffering as their fertile paddy fields mentioned above had been rendered useless on the commission of Loktak Hydro Electric Project. Having no alternative the petitioner association filed this writ petition. Orders of this Court in the present writ petition show that sufficient opportunity have been granted to the respondents to file counter their affidavit- in-opposition but till date no affidavit-in-opposition on behalf of the respondents has been filed. In the absence of the affidavit in-opposition of the respondents, this court can not pass final order directing the respondents to pay exact amount of compensation to the members of the petitioner association in respect of their fertile paddy fields mentioned above. An inquiry will be required to find out the areas of the petitioner association's paddy fields mentioned above which had been rendered useless on the commission of the Loktak Hydro Electric Project. 6. In the above factual context, this writ petition is disposed of at this stage with a direction to the respondents to held an inquiry as to find out exact areas of the members of the petitioner association's paddy fields mentioned above which had been rendered useless on the commission of the Loktak Hydro Electric Project. On making such an inquiry, if it is found that the said whole area or part of the fertile paddy fields mentioned above of the petitioner association had been rendered useless on the commission of the Loktak Hydro Electric Project, the respondents are to fix a reasonable compensation for the damage caused to the fertile paddy fields of the members of the petitioner association and to pay to the concerned members of the petitioner association. The whole exercise should be completed within a period of six months from the date of receipt of this order. 7. With the above observations and direction, this writ petition is disposed of.
