Judgment 1. Heard learned counsel for the petitioner and learned Government Advocate. 2. Initially the writ petition was filed against Annexure-1, a notice dated 13.2.2005 issued by the District Magistrate, Siwan against the petitioner in exercise of power under Section 3(2) of the Bihar Control of Crimes Act, 1981 (wrongly described in the notice as Bihar Control of Crimes Ordinance, 1978). The petitioner could have maintained a writ petition against the notice itself because there is no appeal provided against the notice but in the meantime after noticing the objections raised by the petitioner to the notice the learned District Magistrate, Siwan passed final order on 18.2.2005 under Section 3(3) of the aforesaid Act. 3. Learned Government Advocate has referred to Section 6 of the Bihar Control of Crimes Act, 1981 to submit that against the order of the District Magistrate under Section 3 an statutory appeal has been provided to the Commissioner which may be preferred within 15 days from the date of such order. Still five days are left for preferring the appeal within the statutory period. However, on account of pendency of this writ petition this Court is of the view that even if an appeal is preferred by the petitioner before the concerned Commissioner within one week from today then the same shall be considered on merits and disposed of in accordance with law. 4. Learned counsel for the petitioner has insisted that the appeal be disposed of within a reasonable time because petitioner is elected representative from Siwan and presently he cannot visit that place because of the impugned order contained in Annexure-2. 5. In the facts of the case the appellate authority is directed to hear the appeal expeditiously and decide the same at an early date preferably within two weeks. It goes without saying that if the petitioner is not satisfied with the final order of the appellate authority, he would be at liberty to challenge such order before this Court in accordance with law. 6. The writ petition is disposed of. 7. Let a copy of this order be handed over to the learned Government Advocate.
