Judgment 1. Heard learned Counsel for the appellant and perused the order of the learned Single Judge dated 11.07.2005, partly modifying the order dated 19.02.2005 passed by the learned Civil Judge (Senior Division), Sojat City District Pali in Civil Original Suit No. 62/1990 (51/2001), Gautam Ram & Anr. vs. Ugam Raj. The learned Single Judge while disposing the writ petition has imposed a cost of Rs. 8,000/ -. It is now well settled by a Full Bench decision of this Court in Ramesh Chand Tiwari vs. Board of Revenue reported in 2005 (4) RDD page 615 that a special appeal is not maintainable against an order of the learned Single Judge exercising revisional jurisdiction under Article 227 of the Constitution of India. The conclusion of the Full Bench is summed up in Para 29 which reads as follows:- “Any person desiring to prefer Intra-Court appeal from the Judgment order of the Single Judge, may present the same before the Division Bench but if the Division Bench finds that the Judgment order of the Single Judge was rendered purely in exercise of revisional jurisdiction, the Intra-Court appeal shall stand dismissed as not maintainable. Judgment s orders passed by the Single Judge in exercise of wider supervisory jurisdiction under Article 227 are amenable of Intra-Court appeals.” 2. However, considering all the facts and circumstances of the case, the cost of Rs. 8,000/-is reduced to Rs. 2,000/-, out of which a sum of Rs. 1,000/-will be paid to the respondents No.2 and 3 and the remaining amount of Rs. 1,000/-shall be deposited with the District Legal Services Authority, District Pali. With this modification, the special appeal stands dismissed as not maintainable.
