JUDGMENT 1. - Heard learned counsel for petitioners Virat Sharma and Richard Sabesten, learned Public Prosecutor for the State and perused the relevant documents placed before me. 2. It is inter-alia contended which has not been controverted that similarly situated co-accused Ravinder, Yashwant Singh and Vinod Kumar Sharma have already been admitted to bail by the orders of this court dated 22.8.2005 and 29.8.2005 and the case of the present petitioner is not in any way graver or distinguishable from their case. So, they also deserve to be enlarged on bail. 3. Considering the submissions made at the bar, the nature of accusation, the materials on record and all other facts and circumstances of the case and particularly the fact that similarly situated co-accused persons have already been admitted to bail, the petitioners also deserve the same treatment. 4. In the result, this bail application u/s.439 Criminal Procedure Code is allowed and it is directed that petitioners Virat Sharma s/o Om Prakash and Richard Sabesten s/o Mickle Sabesten shall be released on bail in FIR No.24/05 P.S. Datwas Distt. Tonk for offences under Sections 457 and 380 Indian Penal Code on their furnishing a personal bond in the sum of Rs. 20,000/- each together with one surety in the like amount to the satisfaction of the concerned Court for their appearance before that court on all dates of hearing until conclusion of the trial.Petition allowed. *******
