Judgment Prem Shanker Asopa, J.-The instant D.B. Special Appeal is directed against the order of learned Single Judge dated 23.09.2002 whereby the above referred writ petition filed by the respondent has been allowed and the impugned termination order dated 212.1996 was set-aside and the petitioner has been reinstated on the post of Lower Division Clerk with the further direction that the services of the petitioner be made permanent from 24.05.2004 as per the direction of the Additional Divisional Commissioner and Zila Parishad, Ajmer and the petitioner be paid further arrears of salary with other consequential benefits and continuity in service. 2. Briefly, stated the facts of the case are that the respondent-petitioner filed the above referred writ petition against the termination order dated 212.1996 from the post of Lower Division Clerk on the ground that the said termination order is violative of the provisions of natural justice as well as discriminatory on account of the fact of continuation of junior persons. It was also submitted that the order of the termination dated 212.1996 is contrary to two Judgment s passed in case of his earlier two terminations. 3. The appellants have filed the present appeal with the averments that the reliefs granted by the learned Single Judge are not in accordance with the rules and well established principles of granting limited relief to the employees of Jawahar Rojgar Yojna. The further submission of the appellants is that the post sanctioned from time to time of the said post of Lower Division Clerk in Panchayat Samities was temporary, therefore, there cannot be any regularization and confirmation. Otherwise also the petitioner has not been recruited in accordance with the rules, therefore, he is not entitled for any relief . 4.

The principles of natural justice are only applicable in case the appellant is regular one and in case of appointment against the fixed term post, the same would not be applicable as both the parties are aware of the fact that the sanction of the post is necessary for continuation of the appointment. The petitioner has a right to continue so long as a post continues or any other person junior to the petitioner is continuing. A perusal of the Judgment of learned Single Judge more particularly page 3 and 4 of the certified copy reproduced herein above would reveal that junior persons have been retained also and further fresh appointments have also been given in Zila Parishad, Ajmer. Therefore, the petitioner has a strong case of discrimination and has a right to continue till the persons named in this para are continuing. In such circumstances it would be appropriate for the Zila Parishad, Ajmer to prepare seniority list of Lower Division Clerks and follow the principle of last come first go in case the posts are reduced or abolished. But the petitioner cannot be isolated. 7. A bare perusal of the documents annexed with the writ petition more particularly Annexure 5 and Annexure 12 etc. would clearly reveal that the posts were temporary and period was extended from time to time. It is a settled position in service law that against the temporary post no confirmation can be made. As regards regularization also the post should be atleast regular one i.e., likely to continue in future. Therefore, both the reliefs have not been granted by learned Single Judge in accordance with the settled position of law. 8. In view of the above, the special appeal is partly accepted and the Judgment of the learned Single Judge is set-aside only to the extent of regularization and confirmation. On other issues of reinstatement and continuation, the same is modified to the extent that petitioner will continue in service so long as post continues in project or in Zila Parishad, Ajmer and his junior continues.
